An Insurance Adjuster is assigned to your claim by your insurer, is paid for, and works on behalf of the insurer in the settlement of a claim. A Public adjuster is hired by the property owner and works only on behalf of the insured. An independent adjuster is hired by the insurer to assist the insurance company in the settlement of the claim.
Chapter 18 Title 38.2 of the Code of Virginia establishes licensing, bonding, testing, education, and continuing education requirements for only Public Adjusters or Firms engaged in the representation of effecting the settlement of a claim on behalf of the insured. There are no licensing, education, or surety requirements for insurance adjusters or independent adjusters.
38.2-1845.1 of the Code of Virginia defines public adjusting as an individual or business that receives compensation for, "soliciting, investigating, negotiating, adjusting, or providing advice to an insured in relation to first party claims arising under insurance contracts that insure the real or personal property of an insured for the purpose of effecting the settlement of a claim on behalf of the insured. Public adjusting includes advertising or representing oneself as a public adjuster.
38.2-1845.13 of the Code of Virginia requires public adjuster contracts in the Commonwealth of Virginia contain twelve distinct items. Additionally, a letter of notification, and employment disclosure must be delivered to the insured.
